Anyone,
Could there be any legal ramifications in doing a song that utilizes the name of a particular movie as the title/hook? That is, the song title is not only the same as the movie but SPECIFICALLY refers to that movie in relation to something that happened in the singer's life. (per the song plot)
The film in question is 50 years old (if that makes a difference) but I know that Fox must have the rights to it since they're still putting it out on video.

I know you can't copyright song titles so i'm ASSUMING (key word) that you can't copyright movie titles either...could be wrong...i'm sure someone here knows for sure.

In this case, I think you've brought the problem of the issue out front. Not only are you using the title, but you are refering to the work that uses that title and that could easily be seen as derivative and infringement of some kind. I would check with an attorney who can see the risk and possible infringement angles if you plan to actually do anything commercial with the song. If, on the other hand, you just wrote it and aren't planning commerical use, then there would never be any damages in most cases and you may not need to contact a lawyer until you move forward with the song in some way.
When it comes to infringement, it is often in the eye of the person filing suit until a decision is made by the judge. But winning that type of case is very expensive and major studios have lawyers on staff already.

Thanks for the feedback...I think what I'll do is have it critiqued by a service (who is also a publisher) and get his feedback on the legal question also...I guess if there's a chance of this aspect being a problem that publisher's are gonna be wary of it from the outset...that is, I wouldn't think someone would publish it without without having thought this thru beforehand. (as long as it's a top shelf publisher and not someone who has just set himself up legally to publish, and doesn't know much else besides...the guy I have in mind definately would fall into the first category mentioned)
If necessary, I might even be able to contact the company which has the rights to the film, and see where they're coming from regarding this...I would think that if the song got cut it would only HELP sales of the particular film on video, as the film itself is 50 years old. (of course I'm being optimistic about the song's chances to begin with)
In any case, when I find out the bottom line on this, I'll post the answer in case anyone in the future has a similar question.
