I wonder if it's legal for her to sing a Justin Timberlake song without paying Justin for every single performance of it on YouTube and elsewhere? Seems to me that she'd owe a LOT of money for it. And that's assuming she got permission in the first place. If not, wouldn't it be 10K dollars per infraction and person to viewed it? Ouch.

Well Brian,
Actually there's been some news about that recently. The major labels have been striking deals with YouTube, which will allow users to use their music as background material for their user submitted content. YouTube is about to start running advertising in the video's.
This advertising will be what generates revenue for the copyright holders. How they actually plan on policing that is a mystery to me, but they claim that's what will happen.
What I wonder is, how that will work for non-signed artists like myself and everyone else at JPF. While I have seen 100's of thousands of views yet, I have broken the 10,000 mark.

I have to agree with you Brian, I think it is a little sketchy for her to be singing the JT song on there. It could be considered a public performance. I would hate to pay that fee. I had a friend who was about 18 and like her who now lives in Nashville pursuing her dream. But when she lived back here she didn't have a CD of her own songs so she made one with cover tunes like LeAnn Rhimes and some other big name artists. She sang around clubs and various venues selling those CD's for money. She was clueless about paying any royalty fees. I think this kind of thing happens alot. You guys have to hear the most unbelievable one that happen to me. A couple of years ago I was working at the mall. A co worker asked to borrow one of my CD's for awhile. I let him take it home. He proudly returned it to me a few days later saying how much he enjoyed it. He said he liked it so much he told me he had burned 2 copies for himself. One for his car and one for in the house. I stood there in shock. Later he asked me if something was wrong. I said, ya, you just stole from me. I spent all the money on my CD project and you just burned yourself 2 free copies and even told me you did. Man!!!!!!! To top it off he is a singer/songwriter himself. How do you like that one?? Brian and Tammy, Actually, if you watch the video, at the end, we discover that the person playing the piano and singing backup is Justin himself. Indeed, it is rumored that Esmeee might be the first signing for Justin's new rcord label. Combining that with the fact that I don't think Esmee is actually making any money off of the YouTube posting, I don't think she is in too much danger. Hi again, I did go back last night and watched through the whole thing. I was quite suprised to see JT playing the piano for her. Tammy, Regarding that guy at the mall, he should at least have offered you a trade, like giving you a copy of his CD for one of yours. That would have set much better (with me) between two singer/songwriters networking together, or whatever. I think he owes you a CD or (at least) some money for yours... since he likes your music so much! Michael

i'm not sure on this topic, it would be better handled by a music lawyer I would think it would be handled if it would be handled like a song being performed on TV or at a venue where the TV Network or venue makes payments to ASCAP, BMI, & Sesac I wonder if it's legal for her to sing a Justin Timberlake song without paying Justin for every single performance of it on YouTube and elsewhere? That is probably why it is getting so many views, because JT is shown playing at the end of the video. People are viewing it to see if it is really JT.
So the real lesson here is that if you want a lot of views for your video, have a cameo appearance by a celebrity.

About my CD issue. A trade would have been nice, but I don't think he had any music recorded to trade with. That is what I usually do with people. I guess each situation is different. In that case I thought it was a bit nervy. I did let him know that he should not burn or copy anyone's music. We all work hard for what we do. If I want someone's CD, I go buy it.
