You are talking about a crook who went to prison. I'm talking about the average hard working small business owner that can barely survive in an over regulated market. And yes common sense prevails.
I am sure the over zealous agent continued on his merry over zealous way to the next unsuspecting working man to hand out his ridiculous fines.
What you describe is price fixing. It is supposed to be illegal. But that is the way of things I guess.
