The cop would not grant it.
When the dispatched EMTs arrived there, Floyd was gone. At that point the cops were restraining a dead man. Testimony on Youtube.

If the defense could have made the case:

Our client was forced to subdue a career criminal who had just committed a crime with a police policy restraint employing a knee to the neck.
Once handcuffed and on the ground with multiple officers restraining Floyd, my client allowed an off duty EMT access to Floyd to check his condition.
The criminal continued to struggle and was restrained without a knee to the neck.
Then the criminal died due to causes unknown to my client and beyond his control.

Then you could make a case that he was just doing his job. But that is not how it was.

I'm pro law-enforcement. Criminals are often vicious and lethal and out of control. When I hear stories of them being "roughed up" by the cops, it doesn't keep me up at night. However, neither do I want to live in a society where cop's reckless and unrestrained tactics lead to unnecessary deaths. That's Mexico.

And pro law-enforcement people who think like me are not going to reach in order to figure out a way to argue that he didn't. The cop lost us.
