It would depend on what was actually said, as to whether it was a crime or not.
Maxine Waters told people to accost people in restaurants and give em' hell.
That is not a stretch to assume violence could result.

If it did, should she be charged with a crime if she was no where around?

They would be parsing her words in court.
She never said be "peaceful and patriotic."

I had a neighbor once who had a homeowner insurance claim. He couldn't get it paid for complex reasons.
I am convinced that he tried to set his house on fire to force the insurance company's hand. The circumstantial evidence was damning.
But I couldn't get the cops to do anything, because there was no indisputable proof. (smoking gun in his hand)
